About us: Tour By Me is a travel app that provides our users/holiday makers the freedom to customize their own unique travel experience on the go. The activities and tours (collectively “Activity” or “Activities“) are offered by a variety of third-party local tour guides (“Tour Guides” or “Service Providers”). We act as an intermediary between you and the Service Providers. (“Service(s)”)
Acceptance: Your relationship with us shall be governed by this Disclaimer, and our Terms & Conditions, Cancellation & Refund Policy, Cookie Policy and Privacy Policy statement displayed on the App and the Site. By accessing and/or using our platform, you accept and agree with this Disclaimer, and all our terms and conditions as applicable to you.
Disclaimer:
a) Services provided by third-parties: Please note, it is our third-party Service Providers (Tour Guides or Divers) who provide the services to you booked on our App or Website. These Service Providers are independent individuals or businesses, and these Service Providers are not under the control of Tour By Me or associated with Tour By Me in any manner. Therefore, Tour By Me disclaims all guarantees and warranties in respect to the completeness, accuracy, or quality of such services provided by the Service Providers. Therefore, we do not warrant that the description of services that you find on our App/Site will always be accurate, complete, reliable, safe, current or error-free. Similarly, we do not warrant that their services will always be as expected by you.
b) Insurance: Insurance will be held by our third-party driver organization, and in case of any event that relates to physical damage to the car, car accessories and other related Tour Guide accessories shall not be the responsibility of Tour By Me.
c) Server Downtime: The server of our App/Services may be subject to downtime due to reasons beyond our control, or due to any technical issues. However, our team will ensure that the App and our services come back to normal as soon as possible. We estimate the downtime to be between 6 to 12 hours.
d) Currency Exchange Rate: The currency exchange rate service available on the App is only to help the users have a basic estimate idea about the prices. This is not accurate or up-to-date and shall not be relied upon for the purpose of exchanging currency. The actual currency rate may vary subject to various factors.
e) Applicable Laws: All tours, activities, and services are subject to prevailing guidelines of the appropriate governmental authority. You must follow all the applicable laws and rules, including covid and vaccination related guidelines and directions. Please read all travel and State guidelines as well before booking any
service.
f) Position of Tour By Me: Tour By Me is merely a facilitator and is not and cannot be a party to or control in any manner any offers or deals or transactions of sale or purchase, between the Service Providers and you. You hereby agree that Tour By Me cannot and does not confirm each Service Provider’s purported identity. Tour By Me encourages buyers/tourists to exercise discretion and caution while dealing with any Service Provider. In case of any crimes or emergency health situation, please contact the nearest law enforcement.
g) Further Disclaimer: The App, Site and Services are provided on an “as-is” basis, and Tour By Me (and our licensors and affiliates) expressly disclaims any and all warranties and conditions of any kind, whether express, implied, or statutory, including all warranties or conditions of quality, suitability, accuracy,
reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement of the same. We make no warranty that our App or Site or its emergency buttons will meet your requirements, will be available on an uninterrupted, timely, secure, or error-free basis, or will be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe. Although our App has an emergency button which may help you in any difficult circumstance, but the same shall be subject to availability of resources.
h) Waiver: You hereby waive your right to sue us for any services provided or promised to be provided by the Service Providers, or for any other actions, inactions or breach by either the Service Providers.
